The terms for using KeepTRiX

KeepTRiX is a business-operations platform built and operated by Websketching ("we", "us"). These terms govern your use of keeptrix.com and the KeepTRiX application (together, the "Service"). By creating an account or using the Service you agree to them. Our Privacy Policy describes how we handle information and is part of these terms.

The Service

KeepTRiX keeps one authoritative record of a business — its locations, services, hours, and similar facts — and helps its users keep the places that record appears (business profiles, websites, social pages) consistent with it. Features may be added, changed, or retired as the product develops. Where a feature is described as a preview or pilot, it may change without notice.

Accounts

You must provide accurate account details and keep your login credentials confidential. You are responsible for activity under your account.
Tell us promptly at christine@websketching.com if you believe your account has been accessed without authorization.
You must be at least 18 years old, or the age of majority where you live, to use the Service.

Agencies and their clients

KeepTRiX is built for marketing agencies and the businesses they serve. An agency that manages records, profiles, or pages on a client's behalf represents that it has that client's authorization to do so, and is responsible for the accuracy of what it enters and for what it publishes in the client's name. Access a business grants an agency inside KeepTRiX can be withdrawn by that business at any time.

Your content and data

You own it. The business information, text, images, and other material you or your clients put into KeepTRiX remain yours.
Our license is limited to running the Service. You grant us the rights needed to store, display, process, and — only where you have approved it — publish that material to the destinations you connect. We claim no other rights in it.
You are responsible for it. You confirm that you have the right to use and publish what you upload, and that it does not infringe anyone else's rights or break any law.
You can take it with you. You may export your business records at any time, and may ask us to delete them as described in the Privacy Policy.

Connected platforms

When you connect a Facebook Page, LinkedIn Company Page, Google Business Profile, or similar account, you represent that you are authorized to manage it and you agree to that platform's own terms and policies. KeepTRiX publishes only content that an authorized user has explicitly approved, and never edits a connected profile's underlying business details without an approval step. Each platform controls its own availability and may change or restrict its API; we are not responsible for a platform rejecting, delaying, or removing content, or for changes a platform makes to its terms or services.

Acceptable use

You agree not to use the Service to:

publish content that is unlawful, deceptive, defamatory, or infringes another's rights;
misrepresent a business, its ownership, or your authority to act for it;
send spam, or publish content that violates a connected platform's policies;
probe, scrape, overload, or interfere with the Service or another user's data;
resell or provide the Service to third parties except as an agency serving its own clients through the Service.

Fees

Some parts of the Service are free; paid plans and add-ons are priced as shown when you subscribe. Fees are billed in advance for the period chosen and are non-refundable except where the law requires otherwise. We will give at least 30 days' notice before a price change takes effect on an existing subscription. You may cancel at any time; the plan continues to the end of the period already paid for.

Availability

We work to keep the Service available and your data safe, and we keep backups. We do not promise uninterrupted or error-free operation, and we may suspend the Service for maintenance or for reasons outside our control. Scheduled publishing depends on third-party platforms and may be delayed by them.

Termination

You may close your account at any time. We may suspend or close an account that breaks these terms, poses a security or legal risk, or has gone unpaid after notice. On closure, connected-platform tokens are deleted and your data is handled as described in the Privacy Policy. Sections that by their nature should survive — ownership, disclaimers, limitation of liability — survive termination.

Disclaimer and limitation of liability

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose. To the fullest extent the law allows, Websketching is not liable for indirect, incidental, special, or consequential damages, or for lost profits, revenue, or data, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the twelve months before the claim arose, or $100 if you paid nothing.

Governing law

These terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Pennsylvania, and you consent to their jurisdiction.

Changes to these terms

If these terms change, we will update this page and its effective date. Material changes affecting existing users will be communicated directly before they take effect. Continued use of the Service after a change means you accept the updated terms.
